One of my customers years ago, a small airplane manufacturer, had quit improving it’s planes.
I asked them why.
“It’s like this. If a part has proved to be efficient, we won’t touch it. If someone takes off drunk and forgets to put fuel in the tank, after the crash the lawyers will try and get the nut and bolt manufacturers as plaintiffs in the lawsuit. At least the stuff we have in the plane albeit decades old in design is proved. Many times It is still cheaper to pay what they are asking for than to mount a defense. If it is a new component design, all hell would break loose,” was the response.
I have known of many small companies, some of them my customers who have been sued, some more than once.
Sometimes they fought the suit and many times they just paid.
The problem with this thinking is responsibility. If an employee is a lecher, the employer is responsible for his or her actions.
It is akin to being at fault for car theft when you left your keys inside by accident. To me, the thief had no business taking it regardless.
The law doesn’t look at it that way.
If there is a hole in the sidewalk and you fall in, the only one not responsible for you falling in is you.
That is how bad it is getting. Now if you are blind, it is one thing. But most of us aren’t blind.
That is one reason why insurance and Medical costs are so high.
Yeah, there are a few Doctors that shouldn’t be doctors, but they have criminal courts for that and insurance for the victims.
Nowadays a Doctor can’t afford a tiny mistake.
And who doesn’t make them?
